Bareilly: Two builders booked for carrying out 'illegal' construction in residential colony

BAREILLY: The Bareilly development authority (BDA), during an ongoing drive against illegal land occupation and construction, caught two builders red-handed for carrying out unauthorised construction work at Vishnu Dham Colony in Izzatnagar.

The development authority, during a previous enforcement drive in January this year, had sealed the illegal construction site after the developers failed to provide a building layout approval from the BDA.
It has been learnt that the builders broke the seal put up by the authority and resumed the construction work recently.

Officials at the BDA said that FIRs have been lodged against the two under the Town Planning and Development Act section 26(1), 28(4 ), and sections 188 (disobedience to order duly promulgated by public servant) and 424 (dishonest or fraudulent removal or concealment of property) of the IPC.

Speaking to TOI, BDA secretary AK Singh said, “In January this year, we had launched a crackdown against erring builders in Izzatnagar locality and it’s adjacent areas during which we found that unauthorised construction was taking place for building a residential colony. We then sealed the construction site after the developers failed to produce a BDA-approved building layout plan. Since a construction cannot take place without getting building plan passed in BDA, the site was termed as illegal and was sealed. However, during a recent enforcement drive, it was identified that the same builders had broken the seal put up by the BDA and resumed their work.”

Officials at the BDA said that the decision to file FIR was to ensure that the builders follow rules and flouters think twice before breaking norms.

“There has been perception that the BDA only gives warning to the erring builders and doesn’t penalise them. But, the department will now be dealing with the defaulters in a way to ensure that such offences are not repeated. FIR will be lodged in case of non-compliance. Such drives will be intensified to keep a close tab on such offenders,” BDA vice chairperson Divya Mittal said.
