Indore: Indore bench of MP high court has allowed medical termination of pregnancy of a 15-year-old rape survivor based on a report of medical board constituted in MGM medical college.
Justice Vivek Rusia on Monday directed dean, MGM Medical College and MY Hospital, Indore to admit the petitioner and examine her health condition before termination of pregnancy within 3 days positively as per the consent given by her as required under the Medical Termination of Pregnancy Act, 1971 and health condition.
The petitioner through her counsel Shubham Tanwar moved before court for MTP. She became pregnant after she was allegedly abducted and raped in Shajapur district on November 18, 2022. She is carrying a pregnancy of 13 weeks.
The court in an order dated January 30 this year directed government advocates to arrange a Medical Board composed of experts from the gynaecology department to examine the petitioner' on the same day and submit the report.
The board on February 4 had opined that the petitioner was physically fit for being allowed to terminate the pregnancy. The court directed, “Considering the age of the petitioner, and the agony which she is going through at present and also keeping in view the report of the Medical Board constituted by this Court, deserves to be allowed and is accordingly allowed.”
