FIR against Ahmedabad municipal corporation officer, two others

AHMEDABAD: One day after two labourers died into a sewer near Vishala Circle in Sarkhej , a nodal officer of the Ahmedabad Municipal Corporation (AMC) was charged with culpable homicide not amounting to murder by Vejalpur police.

Vejalpur police filed an FIR on a complaint filed by Gala Mohania , the father of one of the deceased, Sukhram Mohania, a native of Dahod .

It accuses three persons, the contractor K L Savani, labour contractor Fareeduddin Kazi and the “AMC nodal officer”.

On the name of the AMC nodal officer, Inspector L D Odedara of Vejalpur police said he was unaware of the name. AMC officials kept mum on the name of the nodal officer.

On Sunday afternoon, three labourers contracted by the AMC were lowered into a pit near Vishala Circle to clean and take measurements of what is believed to be an under-construction line and chamber for a water supply project.

Two of the three workers, Sunil Raju Palash, 20, and Sukhram, 20, died instantly on being lowered in. The third labourer, Kalu Palash, also entered but as he saw the two fall unconscious, he quickly got out.

This incident flummoxed locals and witnesses. Such deaths usually occur when sewer gas is present. The victims, residents of Sarkhej area, were rushed to VS Hospital by an EMRI 108 ambulance. When their bodies were pulled out, they had no safety gear on them.

The FIR filed by Gala Mohania said that the labourers were told to enter without safety gears and died of asphyxiation.

Vejalpur police filed a case under IPC Sections 304 (culpable homicide not amounting to murder) and 114 (abetment) along with charges under the Manual Scavengers and their Rehabilitation Act, 2013. The three were also charged under the SC/ST (Prevention of Atrocities) Act as the deceased persons belonged to an ST community.
