Jhajjar parcel lands in Chandigarh, firm fined

CHANDIGARH: The District Consumer Disputes Redressal Forum has directed a courier company to pay Rs 5,000 for delivering a consignment booked for Jhajjar in Haryana to a Chandigarh resident.

Bharat Bhushan, in his complaint, said he had sent a parcel from Overnite Express Limited on October 11, 2018, for delivery to his friend Yudhisthir in Jhajjar.

The company promised the delivery within three to four days. After a week, when the consignment did not reach Jhajjar, Bhushan enquired from the company but got no specific response. On November 4, 2018, Bhushan checked online status of the consignment and was shocked to learn it was delivered in Chandigarh.

Bhushan said the company sought more time to track the consignment. He alleged the company had misplaced his consignment. He moved the consumer forum, citing deficiency in service and unfair trade practice. A notice was sent to the company but nobody appeared on its behalf

The forum said, "Overnite Express did not appear to contest the claim of the complainant and preferred to proceed against ex-parte. This act draws an adverse inference against it. The non-appearance of the company shows it has nothing to say in its defence against the allegations. Therefore, the assertions of the complainant go unrebutted and uncontroverted."
