Kerala: Woman protests against husband after Triple Talaq; case registered

A case has been registered against a 35-year-old man for giving Triple Talaq (instant divorce) to his wife.

This comes after the woman, Fatimah Juveria, 24, sat outside his house with their two children for last five days.

She said she didn't want the divorce and sought to live with her family.

To recall, Triple Talaq was recently criminalized by ruling BJP-led central government.

To note, Fatimah filed a complaint against her husband, AK Sameer, who is an accountant in the Gulf, on Thursday.

Subsequently, the Valayam Police in Kozhikode district registered a case under Sections 3 and 4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019, that was passed in July this year.

Furthermore, an investigation is underway in the matter, the police said.

The complainant said that it all started nearly one-and-a-half year ago, when Sameer gave her Talaq, which she refused to accept.

Daughter of a daily wage laborer, Fatimah was married off to Sameer at the age of just 18, as her family couldn't support her financially.

Although, she has stopped the protest now, Fatimah said her fight would continue, until justice was served.

"Sameer's mother and brother used to assault me physically. After that, I had filed a case with police and had also approached family court seeking maintenance," Fatimah said.

She also revealed that Sameer has now remarried. "When I met him outside the court, I questioned him on his remarriage. He told me that it didn't matter to me as he was giving me talaq."

What is Muslim Women (Protection of Rights on Marriage) Act?

The Muslim Women (Protection of Rights on Marriage) Bill, popularly known as Triple Talaq Bill was tabled in the Parliament by Union Law Minister Ravi Shankar Prasad and subsequently passed by both Upper and Lower houses.

The Act bans the contentious practice of Triple Talaq in any form (spoken, written, or electronic), and leads to three years of imprisonment with a fine.
