Man let off despite SC canceling his bail attempted to murder petitioner, says plea in Supreme Court

Noida:  A bench of the Supreme Court on Wednesday issued a non-bailable warrant against the superintendent of the Gautam Buddha Nagar district jail in Uttar Pradesh. Citing the senior official's decision to release an accused whose bail had been cancelled by the apex court, a bench of justices NV Ramana and Ajay Rastogi passed the order.

In a contempt plea, petitioner Prem Chand alleged that superintendent Vipin Mishra "deliberately and willfully violated the order passed" by the Supreme Court. Mishra should be held for contempt of court, pled the petitioner. Prem Chand claimed that the accused committed several offences after he was released from the Gautam Buddha Nagar district jail, including an attempt to murder the applicant. Police have failed to file an FIR in this regards, added Chand.

Apart from issuing non-bailable warrants in his name, Justices Ramana and Rastogi asked Mishra to appear before the apex court on the next date of the hearing which has been decided as of September 23. Mishra has been accused of releasing the accused, Arun, without waiting for the custody warrant as mandated by the country's top court.

Going by reports, a bench of the Allahabad High Court granted bail to Arun on the basis of the fact that he had no priors. However, Prem Chand decided to question the bail order through a special leave petition (SLP). The case was heard after the SLP was converted into a criminal appeal and heard by a bench of the apex court on Wednesday.

In a similar case which came to light earlier this year, a bench of the Calcutta High Court granted bail to a jewellery trader who has been in jail for the past 20 years. The accused in question allegedly robbed a jewellery trader and killed his driver in 1999. A bench comprising Justice TB Radhakrishnan and Arijit Bannerjee took the call and decided to let off the accused.

Similarly, the Bombay High Court granted bail to seven convicts, earlier this month. These men were accused of murdering a 32-year-old cable operator in June 2010. After serving nearly a decade in jail for the murder of one Suresh Waghmare. The bench had cited several reasons behind its decision to grant them bail, including the attendance in the trial court on first Monday of every January and July of every calendar. A police investigation into the matter had revealed that the crime was the fallout of a rivalry over monopoly in the cable network business.
