Patna court seeks report on execution of warrant against government doctor

PATNA: A special POCSO court in Patna on Wednesday sought a report from Patna SSP on December 3 on the execution of a non-bailable warrant issued by it against government doctor Pushpa Prakash , who failed to depose even after several notices in a rape case.


Dr Prakash, who was posted at New Gardiner Hospital , had examined the 17-year-old rape survivor and prepared the medical report.

Since she did not depose in the case despite several notices, the POCSO court issued a non-bailable warrant against her.

Special public prosecutor Suresh Chandra Prasad said the court had issued the warrant against Prakash on October 25 to appear on November 5. “Neither did she appear before court nor the police executed the warrant against her,” he said.

Prasad said on the next hearing on November 20, police again failed to execute the warrant and produce Dr Prakash,” he said.

The special prosecutor said he had to finally submit before the court that it was due to the inefficiency of police that the court order had not been complied with, which was delaying the trial of the case.

The incident took place on May 27 last year when the victim was alone inside her flat at Pataliputra Colony in the state capital and accused Anjay Pandey (30) forcibly entered inside and raped her. The victim’s father had gone out of Patna with his wife when the incident took place. The FIR was lodged with Pataliputra police station against Pandey on May 30 after her parents had returned.

According to police, Pandey was actually working as the driver of the victim’s father, who had removed Pandey from the job a week before the incident. Pandey, in a fit of rage, had raped the minor. He was arrested from Maner in western Patna.
