Court convicts man of killing 92-year-old, his daughter-in-law

New Delhi: A Delhi court has convicted a man of murdering a 92-year-old and his 64-year-old daughter-in-law in a robbery bid in June 2015, stating that the chain of circumstantial evidence against him was complete and the prosecution had duly proved the charges.

Additional sessions judge Shefali Barnala Tandon, in the 117-page judgment noting various aspects of the case, including robbery being motive of the crime, evidence regarding the accused’s presence at the spot, his accessibility to the deceased’s house, and his conduct after the crime, said, “All the circumstances established are consistent only with the hypothesis of the guilt of the accused.”

The court was hearing a case against Deepanshu aka Deepu who was accused of murdering Sewa Ram Kataria and Shashi Kataria with a pair of scissors in their house in East Patel Nagar on June 14, 2015.

Stating that the deposition of all independent witnesses had remained “coherent, reliable and trustworthy”, the court remarked, “In the present case, the prosecution has been able to prove the complicity of accused Deepanshu in the commission of crime beyond the shadow of all reasonable doubts.”

The court convicted the accused on April 30 under sections 302 ( murder ) and 397 (Robbery, or dacoity, with attempt to cause death or grievous hurt) of the IPC and posted the matter for hearing the arguments on sentencing on a later date.

The post-mortem report had revealed that Sewa Ram had 11 stab wounds and the cause of death was a head injury after "the forceful thrust of a stabbing weapon into the head”.

The report also stated that Shashi had six stab injuries and her death was also caused by a blunt force trauma to the head. “Thus, keeping in view the forensic evidence, the medical evidence, the recovery of robbed articles at the instance of the accused, the scene of the crime report, the photographs of spot, the medico-legal case and post-mortem reports…it is held that the prosecution has been able to complete the chain of circumstances,” the court concluded.
