NGT imposes fine on Delhi Jal Board for repeated delays in groundwater extraction case
New Delhi: The National Green Tribunal (NGT) expressed dissatisfaction with Delhi Jal Board 's (DJB) continuous postponements in a legal matter involving unauthorised groundwater extraction by hotels and imposed a fine of Rs 50,000.
The tribunal levied a penalty on DJB for their lack of cooperation, stipulating that the funds be allocated towards the acquisition of environmental books to be kept at the NGT bar room. It has mandated the personal attendance of the DJB chief executive officer at the hearing scheduled for Aug 12.
In an order dated July 7, a bench headed by NGT chairperson Justice Prakash Shrivastava described the water utility's conduct as "not bonafide". The tribunal was hearing an execution application filed to ensure compliance with a 2018 order passed in a case originally flagged by activist Shailesh Singh. The case alleged that several hotels, including The Suryaa in New Friends Colony, were illegally drawing groundwater — a practice that continues, the petitioner alleged.
At the latest hearing on July 7, DJB once again sought an adjournment, citing that its counsel was "not in station", a reason it submitted on earlier occasions as well, the NGT has observed. "Repeated adjournment by DJB on the same ground that "counsel is not in station" does not appear to be bonafide. The above allegation of the applicant seems to carry weight," the order said.
Finding merit in the applicant's claim that DJB was deliberately delaying proceedings, the bench observed that the board's conduct was obstructing justice and directed DJB CEO to appear before it in person at the next hearing on August 12.
"We require the CEO, DJB, to appear on the next date of hearing to assist the tribunal," the bench added.
