Bengaluru stampede: Karnataka govt moves HC against CAT order quashing IPS officer Vikash Kumar Vikash's suspension; says tribunal ignored dereliction of duty

BENGALURU: The Karnataka government on Wednesday moved the Karnataka High Court against the order passed by the Central Administrative Tribunal (CAT), Bengaluru bench, quashing the suspension of IPS officer Vikash Kumar Vikash in relation to the June 4 stampede incident outside Chinnaswamy Stadium , wherein eleven people lost their lives.

The petition was mentioned by Advocate General Shashikiran Shetty before a division bench headed by Justice S G Pandit for urgent hearing, and the bench indicated that it would take up the same on Thursday.

On Tuesday, the tribunal had set aside the June 5 suspension order pertaining to Vikash, pointing out that the state government had mechanically passed the order against police officers without sufficient material grounds.

The tribunal had even observed that it was RCB’s social media posts which led to the large congregation of people outside the Chinnaswamy Stadium.

In its petition challenging the said order, the state government has claimed that the tribunal had failed to consider other aspects mentioned in the suspension order, which prima facie indicated substantial dereliction of duty on the part of the officers.

The state government further added that the tribunal has given specific findings regarding the entire incident as if it were a departmental enquiry, and the same is contrary to settled principles of law pertaining to suspension matters.
