Reservation for economically-backward candidates: Kerala HC dismisses PIL

KOCHI: The Kerala high court has dismissed a public interest litigation (PIL) filed by Samastha Nair Samajam (SNS) seeking 10 per cent reservation for economically-backward candidates in higher secondary courses.


A division bench comprising chief justice S Manikumar and justice Shaji P Chaly considered a PIL (WP-C No.

15916/2020) filed by SNS.

It was alleged by SNS that the prospectus for admissions has been issued without taking note of the constitutional amendment to Article 15(6). State government contended that it has not issued a notification providing such reservation.

While dismissing the PIL, the court pointed out that Kerala Education Act governs admissions and appointments in the state and that the petitioner has not made out any prima facie case for ordering notice to the government. The petitioner can file a fresh petition if there is substantive cause, the order said.
