High Court Halts Salaries of Officials Over Delayed Pension

The Punjab and Haryana High Court has taken the unusual step of suspending the salaries of several government officers until a long‑standing pension dispute is resolved. The order follows a petition by Jagdish Raj Aroda, who claims his wife, a former Block Primary Education Officer in Gurudaspur, has not received her pension or arrears since 2007.

Background of the case

Jagdish Raj Aroda approached the High Court after repeated attempts to obtain his wife's pension proved futile. According to his counsel, the pension department kept directing him to different offices without actually processing the payment. The pension in question dates back to 2007, and the arrears have remained unpaid for over a decade.

Court's findings

Justice Kuldeep Tiwari, presiding over the matter, observed that there was no substantive dispute over the amount due.

The delay appeared to be caused by administrative inertia rather than any legal contention. The court noted that the District Treasury Officer had been advised in September 2012 to release the arrears, yet the Treasury continued to postpone the payment. The bank handling the pension also insisted on a clearance from the Treasury before disbursing any funds.

Orders issued

In response, the court ordered that the salaries of four officials be withheld until the pension is paid in full.

These officials include the Secretary of School Education, a senior officer from the Finance Department, the District Education Officer of Gurudaspur, and the District Treasury Officer. Additionally, the Deputy Manager of the Bank of India branch and the senior manager of the same branch were directed to have their salaries stopped.

The court made it clear that no salary would be released without its explicit permission, and it will remain so until proof is provided that the petitioner’s pension and arrears have been settled.

Next steps

The matter is scheduled for a further hearing on 26 November. Until then, the affected officials will remain without pay, a move the court described as necessary to compel the responsible departments to act promptly.
