SC to hear Danam's plea against disqualification on Sept 23
Hyderabad: The Supreme Court on Monday agreed to hear on Wednesday a special leave petition filed by Danam Nagender challenging the Telangana high court ’s order disqualifying him from the assembly under the anti-defection law .
A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana Prasad directed that the matter be listed on Wednesday after Nagender’s counsel sought an urgent hearing.
During Monday’s proceedings, senior advocate Mukul Rohatgi , appearing for Nagender, sought an urgent hearing, arguing that any delay could pave the way for the Election Commission to issue a by-election notification for the Khairatabad assembly constituency , which Nagender represents. He requested that the matter be taken up on Tuesday.
On Sept 18, a division bench of the high court disqualified Nagender, setting aside an earlier order of the assembly speaker that had rejected petitions seeking his disqualification. The petitions were filed by BJP legislature party leader Alleti Maheshwar Reddy and BRS MLA P Kaushik Reddy.
Nagender moved the Supreme Court on Sept 19 challenging the high court verdict.
Opposing the plea, Maheshwar Reddy and Kaushik Reddy, who had filed caveats before the apex court seeking an opportunity to be heard before any interim orders are passed, urged the bench to hear all parties before proceeding further. They requested that the case be listed on Wednesday.
Taking note of the rival submissions, the bench directed that the matter be posted for hearing on Wednesday.
In its Sept 18 judgement, the high court held that Nagender incurred disqualification from April 23, 2024, after contesting the Secunderabad Lok Sabha election as a Congress candidate while continuing as a BRS MLA from Khairatabad. The court subsequently declared the assembly seat vacant.
