Actor Imran Khan Asked to Leave India by October 28: What Is His Citizenship Status?

Bollywood actor Imran Khan has repeatedly been coming into the spotlight, after the notice reportedly issued by the Mumbai Police, asking him to leave India by October 28, 2026. The action occurred due to his participation in a CJP-led protest against the Chief Election Commissioner Gyanesh Kumar, at Mumbai's August Kranti Maidan on October 10th.

This development has also led to many questions regarding the actor's original nationality. Imran Khan is said to be a US citizen, while also holding an Overseas Citizen of India (OCI) card. People are confused about what his OCI status means, and whether it grants him an Indian citizenship, or not.

What Is an OCI Card ?

Overseas Citizenship of India, more commonly known as OCI, is a scheme introduced by the Indian government for foreign nationals who are eligible and hold qualifying Indian-origin connections. The card offers its holders various benefits, such as a lifelong, multiple-entry visa for visiting India, subject to the applicable rules.

And despite the word ‘citizen’ in its name, the card actually does not make its holder an Indian citizen. The Ministry of External Affairs states extremely clearly that an OCI card must not be confused with a dual citizenship. Therefore, OCI cardholders remain foreign nationals and actually hold passports issued by their respective countries.

So, Does the OCI Status Give Imran Khan Indian Citizenship?

No. As stated before, an OCI card does not automatically grant Indian citizenship to its holder, now be it Imran Khan, or any other eligible foreign national. The reports identify him as a US citizen who holds the OCI status.

Further, it should be noted that under India's Citizenship Act, 1955, a person who acquires a foreign citizenship generally ceases to be an Indian citizen, subject to the provision's terms.

However, it is also possible for eligible OCI cardholders to apply for an Indian citizenship, provided they meet the prescribed legal requirements.

What Does Indian Law Say About the Current Case?

The reported notice to Imran Khan has brought the people’s attention to the rules which concern the governing of foreign nationals in India. While the OCI cardholders may enjoy several privileges, they do not actually possess all the rights available to Indian citizens.

However, there is a difference between having citizenship rights and the legality of participating in a protest. The restrictions which were allegedly violated, and the other subsequent official findings should be established and rechecked from the relevant authorities. The notice itself is not to be treated as proof for the allegations against the actor.

This controversy surrounding Imran Khan highlights a very common misunderstanding about OCI status of people. The card offers foreign nationals certain long-term benefits, but it does not permit them to full dual citizenship.

As the October 28 deadline approaches, further developments may clarify the legal basis of the notice. But for now, what we can say for sure, is that holding an OCI status and being an Indian citizen are two different legal positions under Indian law.
