Insurance Claim: In today’s times, it has become absolutely essential for the name—and its spelling—to be consistent across all important documents. Even a minor error can lead to significant complications in banking, insurance claims, and government-related procedures.

People often find themselves running from pillar to post simply because of a minor discrepancy in the spelling of their name across various documents. But can changing one’s surname after marriage truly pose an obstacle to an insurance claim?

A rather startling case has emerged from Yamuna Vihar in Delhi. Here, a woman named Preeti Windlesh purchased a life insurance policy from ‘ING Vysya Life Insurance’ in the year 2012. In December 2023, when the policy reached its maturity date, the company issued a check in her name amounting to approximately ₹5,12,069.

Bank Cites Mismatch in Account Name

The case took an unexpected turn when the woman deposited this check at her bank to claim the policy proceeds. In response, the bank refused to disburse the insurance funds to the customer. The bank cited a mismatch between the name on the check and the name registered in her bank account as the reason for the refusal. Consequently, when the woman presented the check, the bank flatly declined to release the insurance amount, citing the name discrepancy in the account and technical regulatory protocols.

According to the information available, the check had been issued under the woman’s former name, ‘Preeti’; however, following her marriage, she had updated her name to ‘Preeti Windlesh’ across all her legal documents and her bank account.

Consumer Forum Reprimands Company

Distressed by this gross negligence on the part of the company, a woman appealed to the North-East District Consumer Disputes Redressal Commission (Consumer Forum) for assistance. The Forum expressed strong displeasure over the insurance company’s negligence. Holding the company guilty of ‘deficiency in service,’ the Forum asserted that a consumer’s valid and legal claim cannot be withheld solely on technical grounds or due to a change in name or surname following marriage.

Furthermore, issuing a stern reprimand to the insurance company for withholding a maturity amount running into lakhs, the Forum ordered the payment of the sum along with interest and a hefty penalty. It is pertinent to note that an insurer promises to pay an agreed-upon sum to a policyholder in the event of death or an accident. In exchange for this promise, the policyholder agrees to pay a fixed amount at regular intervals for a specified duration.
