The Reserve Bank of India (RBI) has established specific guidelines for banks, recovery agencies, and NBFCs. According to these rules, recovery agents must behave courteously and refrain from any form of misconduct, harassment, or abusive behavior.
Being aware of these rules allows you to take appropriate action and speak out against any mistreatment. While banks and financial institutions have every right to recover their funds, they cannot treat borrowers in a humiliating manner; hence, these regulations exist to protect customers.
What can and cannot recovery agents do?
Respect for your privacy is mandatory
Recovery agents do not have the authority to disclose your financial status or debt details to your family, neighbors, friends, or office colleagues. Publicly shaming you or sharing your information with others to recover the debt is strictly prohibited.
No harassment or threats
Recovery agents cannot send repeated harassing calls or messages, nor can they issue threats; any form of intimidation regarding the loan is disallowed. They cannot visit your home without permission or humiliate you on social media—such actions violate the rules. Furthermore, they cannot exert pressure by posing as police officers, legal representatives, or government officials.
Fixed contact hours
According to the Reserve Bank of India (RBI), recovery agents cannot call you at just any time. According to RBI guidelines, recovery agents may only contact borrowers between 8:00 AM and 7:00 PM. Repeated calls, persistent harassment, or calls made outside these stipulated hours can be considered a violation of the rules. If a recovery agent engages in such behavior, you can lodge a complaint with the bank, the NBFC, or the Reserve Bank of India (RBI).
What should you do if harassment by loan recovery agents persists?
Keep all evidence safe
If recovery agents call you repeatedly, note down the caller’s name, the time of the call, and the date. Maintain a record of every phone call and preserve any SMS or email messages sent by them. These records will strengthen your case should you need to file a formal complaint in the future.
Verify the recovery agent’s identity
According to RBI guidelines, a bank cannot disconnect or block your phone connection simply because you are unable to pay your loan installments. If a recovery agent calls you, ask them to present their ID card and the authorization letter issued by the bank. Do not share any personal or banking information with anyone without first verifying these documents.
