SC To Revisit UAPA Bail Standards As Umar Khalid Case Sparks Bigger Constitutional Debate

The Supreme Court has decided to revisit the legal principles governing bail under the Unlawful Activities Prevention Act, or UAPA, while hearing matters linked to activist and former JNU student Umar Khalid in the 2020 Delhi riots conspiracy case. A bench of Justices Aravind Kumar and PB Varale referred the issue to a larger bench after conflicting judicial observations emerged over how bail should be interpreted under India’s anti-terror law. The development comes after another Supreme Court bench recently remarked that “bail is the rule and jail is the exception” even in UAPA cases, while also questioning earlier rulings denying bail to Khalid and co-accused Sharjeel Imam. Khalid, who has been in Tihar Jail since September 2020, faces charges linked to the Delhi riots that left 53 people dead. The case has now evolved into a larger constitutional debate over prolonged incarceration, individual liberty, and the interpretation of stringent anti-terror laws in India.
