If Not a Passport, What Proves Indian Citizenship? MEA Clarification and Key Facts Explained
On Passport Seva Diwas on June 24, 2025, the Ministry of External Affairs officially stated that an Indian passport is a travel document and not a document of citizenship. The clarification came in response to a specific legal question: could a person excluded from the Election Commission's Special Intensive Revision of electoral rolls use their Indian passport to prove citizenship? The answer, according to the MEA, was no. This sparked a much wider debate across India, since most citizens assume commonly held government documents automatically serve as proof of their nationality.
Why a Passport Does Not Prove Citizenship
The MEA has formally stated that a passport is issued primarily for international travel, accessing consular services abroad, and identification outside India. While it is issued only to Indian citizens and the Passports Act requires authorities to reject applications from non-citizens, it is legally classified as a downstream document built on other identity proofs. Courts do not treat it as a root-level document for establishing citizenship. Under the Passports Act, the government also retains the right to revoke a passport if it was obtained using false information.Why Aadhaar, Voter ID and PAN Do Not Prove Citizenship Either
The Supreme Court has clearly ruled that an Aadhaar card is a proof of identity and residence only. It can be issued to any resident of India, including non-citizens. A Voter ID card is issued for electoral participation and serves as proof of registration on the electoral roll, not nationality. A PAN card is a tax identification number issued by the Income Tax Department. A ration card is issued for welfare scheme access. A driving licence proves the holder is authorised to operate a vehicle. All of these are identity or functional documents, not legal proof of nationality.
